These Terms govern the relationship between (AI)글로벌에듀 ("Company") and users of X10LAB (x10lab.ai) and related services (Guppy, Marlin, the "Services"). In case of any discrepancy, the Korean version prevails.
These Terms set out the rights, obligations, responsibilities, and conditions and procedures of use between the Company and users.
These Terms take effect upon posting where users can review them. The Company may amend them within the limits of applicable law (including the Act on the Regulation of Terms and Conditions and the E-Commerce Act), giving notice with the effective date and reasons at least 7 days in advance (30 days for material or unfavorable changes), via the service screen and email where possible. Where the notice clearly states that silence constitutes consent and the user does not object by the effective date, the user is deemed to consent; users who object may terminate before the effective date. Individual service contracts (e.g., Guppy contracts) prevail over these Terms where they differ.
Marlin is a brokerage/agency-type service that creates and runs instances with Providers at the user's instruction; user workloads and data are processed on Provider infrastructure, primarily located overseas, and the Provider's own terms and acceptable-use policies may also apply (as indicated on the service screen). The Company may change the Services for reasonable operational/technical reasons; material unfavorable changes (including discontinuation) will be announced 30 days in advance, with unused Credits refunded per Section 9 if a paid service is discontinued for the Company's reasons. Beta Services (currently Marlin) may change or be discontinued without notice as labeled; however, this does not exclude refunds for paid portions or the Company's statutory liability.
The contract is formed when the user agrees to these Terms, applies per the Company's procedures, and the Company accepts. The Company may withhold or refuse acceptance for false/third-party information, prior termination for breach, or technical constraints. The Services are not available to persons under 19. A person signing up for an entity warrants due authority to represent it.
The Company will provide the Services continuously and stably in good faith, protect personal data per law and its Privacy Policy, handle justified complaints promptly (or notify reasons and schedule), exercise reasonable care in selecting and integrating Providers, and promptly inform users of Provider-side failures it becomes aware of.
Users must comply with laws, these Terms, and Company notices; safeguard credentials (account, API keys, SSH keys) and immediately notify the Company of any compromise (users bear damages enlarged by delayed notice, except where the leak is attributable to the Company). Users must not: infringe others' rights (including IP and personal data); use compute for unlawful or harmful purposes (unlawful crypto mining, attacks, malware, illegal content, sanctioned activities); violate Provider terms/AUPs; disrupt the Services or Provider infrastructure; or transfer/rent/resell accounts or Credits without consent. Users are responsible for the legality of and rights in the workloads, inputs/outputs, and results they run on Providers, and shall indemnify the Company (including reasonable defense costs) for third-party or Provider claims arising from the user's breach, to the extent attributable to the user.
